RIVERSIDE BOROUGH COUNCIL
The Riverside Borough Council met in the Municipal Building, 415 Dewart Street, Riverside on Monday, November 7, 2022 at 7:00pm. Meeting was called to order by President John Domanski. Council members present: Vice President Barb Kriner, Peter Fleming, Brian Whitenight, April Shuman and Beth Rake. Also present were Solicitor Joseph Michetti Jr., Chief of Police Kerry Parkes, Mayor John LaMotte, Zoning Officer Brian Anderson and Secretary Lisa Fritz. Citizens present in the Audience were residents Leah Tedford and Clark Shuman. Pledge of Allegiance Citizens to be Heard: Resident Leah Tedford had a concern about walking after dark in the neighborhood, stating it is very dark. She asked if something could be done to illuminate the streets better. She said there are dogs that come off their property out into the street as she is walking her dog and due to the darkness, she cannot see these dogs coming near her. Peter Fleming stated since COVID, the dog population has increased and a lot of people are taking advantage of the recent warmer weather this November. John Domanski suggested that Lisa put a message on Facebook regarding dogs being contained to their yard or on a leash. Kerry stated that command to a dog can be verbal or physical. Kerry told Leah Tedford that she should call the police if any dogs are not controlled or contained in their own yards. Beth Rake asked Leah if she carries Pepper spray, Leah stated she does. President, John Domanski stated Council will check into lighting. Leah Tedford also mentioned how a tractor trailer truck drove through the corner of her property. Beth suggested a boulder, but stated that several boulders have been drug by trucks in the Borough. Old Business: Minutes of 10/17/2022 were approved by all. Update on Sanitary work; Notices were mailed to residences in the areas were the Smoke Testing will be performed. Notices were also mailed to the residences in the areas where the Sanitary Sewer System improvements will be done. Barb Kriner made a motion to accept the Old Business, with Brian Whitenight seconding the motion. All in favor. Zoning Officer Report: Brian Anderson read his report. Brian stated he stopped by the property with the broken fencing to speak with the owner regarding repairs to the fence, but the owner was not home. Barb Kriner made a motion to approve the Zoning Report, Peter Fleming seconded. All in favor. Street Department Report: Barb Kriner stated she has a contact at PPL for the damaged roads. John LaMotte said he had to weld the Collar for the leaf collection machine and feels a new Collar should be ordered, as the current collar has been welded multiple times. The Street Department requested permission to order four new office chairs, Barb Kriner made a motion to approve the Street Department to purchase four new office chairs, not to exceed $1,000.00 for all the chairs. Brian Whitenight seconded the motion. Barb Kriner made a motion to accept the Street Department report. Brian Whitenight seconded the motion. All in favor. Southside Fire Company Report: Barb Kriner stated she did not have the Fire Company’s report for the month of October. Police Report: Kerry Parkes read his report. He stated there has been an issue with uploading data. The company is working on the issue. Kerry plans to request an extension of the contract due to the upload issues. NIBRS Training (National Incident-Based Reporting System) has been scheduled. Trick or Treat night went well, with no major issues. Local Law Enforcement Grant application was submitted. Kerry stated there is a new motorcycle club being formed by the Tattoo business in Riverside and they planned a party for Saturday, 11/12. All Police Officers will be on duty that day. Resident, Leah Tedford asked how long the Tattoo Parlor has been in business, Kerry stated the business has been in Riverside for two years. Kerry Parkes stated they have built a bar in the garage area of the building. Kerry said the Street Department truck was placed on MuniciBid and on Facebook for $4,500.00. Barb Kriner motioned to accept the Police report, Peter Fleming seconded. All in favor. Mayor’s Report: The Mayor had nothing to report. Solicitor Michetti Report: Attorney Michetti drew up an Easement between property owners, Knouse and Riverside Borough for the placement of the ‘Welcome to Riverside Borough sign’. The Easement will survive the Grantors/Grantees. Peter Fleming met with the Knouses’ to go over the Easement, they are not in agreement to supply power from their property to illuminate the sign. Beth said perhaps some type of Solar lighting could be used. The Solicitor stated the Borough will be liable for the maintenance of the sign and any adverse effects that might occur. There is a business in the Borough that is not paying the LST (Local Service Tax) to the Borough. Attorney Michetti stated the people working at the business could be private contractors and they are not required to pay the tax. Beth Rake made a motion to accept the Solicitors Report, with Peter Fleming seconding. All in Favor. Borough Life: Beth Rake stated the Halloween night was successful this year, with a steady line of kids from 6:00-9:00pm. She stated Doug Heimbach, Boy Scout Leader said he will have more kids next year, as he signed 50 new kids up for Boys Scouts. The “Parade of Lights”, which is set for Saturday, December 3rd at 5:30pm. The parade will follow the same route as last year. Council will meet soon to finalize the plans for the parade. Barb Kriner made a motion to accept the Borough Life report. Peter Fleming seconded the motion. All in favor. New Business: Council decided not to implement a Sewer Billing upgrade for now. Motion to Approve: No Motions to approve. Action Items: April Shuman mentioned that PSAB has companies willing to meet with Council to discuss Grant Writing. April will set up a meeting for Wednesday, 11/16 at 6:30pm. April received a letter from the Danville Municipal Authority stating they will be charging surcharge fees for high strength discharges in the Riverside System. Peter Fleming questioned what protocols Danville is using to do the testing. April state the testing Protocols are in the contract. April will provide Council Members with a copy of the contract. Council will meet and come up with questions for the Danville Municipal Authority. April stated the levels have been low in some areas and higher in other areas the last few times the sewer was tested. Danville has not pin-pointed where the high testing comes from. John Domanski stated Council is meeting with Lenders to discuss financing for the new building. John said the contractors probably will need to use the 60 foot right-of-way to do the demolition work on the building. Solicitor, Joseph Michetti suggested the property for the new building be surveyed. Peter Fleming motioned to have the property surveyed and accept the Action Items, Brian Whitenight seconded the motion. All in Favor. There was no Executive Session. The Riverside Borough Council met in the Municipal Building, 415 Dewart Street, Riverside on Monday, October 17, 2022 at 7:00pm. Meeting was called to order by President John Domanski. Council members present: Vice President Barb Kriner, Peter Fleming, Brian Whitenight, April Shuman and Beth Rake. Also present was Secretary Lisa Fritz. No citizens were present in the Audience. Pledge of Allegiance President John Domanski made a presentation to Street Superintendent, Dan Gable of a monetary donation collected by Council Members, the Solicitor and other Borough staff. Old business: Approval of the minutes of October 3, 2022 which was done by Motion of Beth Rake, seconded by Peter Fleming. Approved by all. John Domanski read a ‘Thank You’ card from the family of Gladys Magill for the donation the Borough made. Borough Life: Beth Rake stated that Borough Life is hosting a Halloween gathering at the Borough building on Saturday, October 29th during the Trick-or-Treat hours of 6:00pm until 9:00pm. They will be doing S’mores and hotdogs over a campfire, hot cocoa, popcorn and candy. The Boy Scouts will be hosting ‘Trunk or Treat’ at St. Peter’s Church. After Halloween, the committee will get together to discuss the “Parade of Light”, which is set for Saturday, December 3rd. Barb Kriner made a motion to accept the Boro Life report and Peter Fleming seconded the motion. All in favor. Action Items: Resolution No. 22-10-17 was adopted eliminating Police Officers’ contributions to the Police Pension Plan for 2023. Peter Fleming made a motion to adopt the resolution, Barb Kriner seconded the motion. All in favor. Peter Fleming will talk to the Knouses’ regarding the ‘Welcome sign’ placement in their yard. An Easement will be drawn up by the Solicitor for the sign placement at the Knouse property. An electrical outlet will be installed for the sign. Council agreed to pay $100.00 per year for the electricity of the sign. Brian Whitenight questioned if the pine tree on the Knouse property would be taken down, as he stated it is diseased. Peter Fleming will speak with the Knouses’ about removing the tree and having the stump grinded out. At 7:35pm, Barb motioned to move into the Executive Session, Beth Rake seconded. All in favor. At 7:49pm, Beth Rake made a motion to move back into regular session, Peter Fleming seconded. All in favor. Beth made a motion for John Domanski and Barb Kriner to represent and make decisions on behalf of the Borough in regards to the pending Whitenight case. Peter Fleming seconded the motion. The Riverside Borough Council met in the Municipal Building, 415 Dewart Street, Riverside on Monday, October 3, 2022 at 7:00pm. Meeting was called to order by President John Domanski. Council members present: Vice President Barb Kriner, Peter Fleming, Brian Whitenight, Delavan Whitenight, Jr., April Shuman and Beth Rake. Also present were Solicitor Joseph Michetti Jr., Chief of Police Kerry Parkes, Street Superintendent Dan Gable, Zoning Officer Brian Anderson and Secretary Lisa Fritz. Citizens present in the Audience were Clark Shuman, Oliver and Maighread Kelly. Pledge of Allegiance Citizens to be Heard: Oliver and Maighread Kelly of South Mill Street expressed concerns about the noise from trucks using jake brakes on Sunbury Road. They stated this noise disrupts the quality of life in the Borough. The Kelly’s questioned if the drivers could be asked to refrain from using jake brakes in the Borough. Chief of Police, Kerry Parkes stated Sunbury Road is a PennDot Road. Route 54 into Riverside is deemed a ‘ No Jake Break Zone’. A noise Ordinance resolution was given to the Kelly’s. Delavan Whitenight stated the jake brakes are a safety feature and once you take your foot off the gas pedal, the break retarders automatically come on. Peter Fleming stated it seems the newer model trucks are much quieter than older models. Oliver Kelly asked if a sign could be placed stating, “Please be kind of noise in our neighborhood”. Barb Kriner will contact PennDot to discuss the issue. Old business: Approval of the minutes of September 19, 2022 which was done by Motion of Barb Kriner and seconded by Beth Rake. Approved by all. Zoning Officer Report: Brian Anderson read his report and stated he issued 16 permits during the month of September. John Domanski questioned if the fence that was exposed due to brush removal has been repaired by the resident. Brian Anderson stated he will contact the owner and let them know they should repair the fencing. Beth Rake made a motion to approve the Zoning Report, Peter Fleming seconded. All in favor. Street Department Report: Dan Gable presented his report, stating many items were worked on over the month of September, including work on Coyote Lane. There still seems to be a problem with water laying in the potholes, this is due to water run-off. Dan Gable said the Street Department tried to create a swale on the Borough right-of-way to re-direct the water. Brian Whitenight stated they are not finished working and the contracted company should put the grounds back to original condition. Dan should keep track of time and materials regarding this issue. John Domanski and Dan Gable will look at the situation and contact the company doing the work. Dan stated a private sewer line was repaired on Avenue E, during this repair the Borough’s sewer line was collapsed. Dan received a quote to repair the Borough’s line in the amount of $2,000.00. Dan questioned if Nathan Apple (whom was hired temporarily, full-time for 6 months) will be paid over-time or can use comp-time. Attorney Michetti stated over-time pay will have to be given, no comp-time. Delavan suggested a spot light for on the Street Department bucket truck, so drivers can see them clearly. Leaf collection will be from October 17th through November 23rd, or longer if need be. Barb Kriner made a motion to accept the Street Department report. Peter Fleming seconded the motion. All in favor. Southside Fire Company Report: Barb Kriner read the Chief’s report. The Fire company will be selling Christmas trees again this year. Delavan Whitenight Jr motioned to accept the report, with Brian Whitenight seconding the motion. All in favor. Police Report: Kerry Parkes presented Street Superintendent, Dan Gable with a donation the Police Officers collected for him regarding Dan’s leave of absence. Kerry stated Magistrate money was down for the month of September. Lights have been installed in the Pavilion, they are on a timer. They can be turned off if need be, but should be turned back on. Beth Rake motioned to accept the Police report. Brian Whitenight seconded. All in favor. Mayor’s Report: No report, as the Mayor was not in attendance at the meeting. Solicitor Michetti Report: Attorney Michetti had nothing to report. Borough Life: Beth Rake stated that Borough Life is hosting a Halloween gathering at the Borough building on Saturday, October 29th during the Trick-or-Treat hours of 6:00pm until 9:00pm. Brian Whitenight made a motion to approve the Secretary’s raise, with Beth Rake seconding the motion. All in favor. A State Aid Allocation for pension plans was received in the amount of $51,804.51. A ‘Thank You’ card was received from Milton Borough for Riverside Borough’s old office chairs that was donated to them. Motion to Approve: A Sewer evaluation on the East was estimated in the amount of $49,900.00 for Smoke Testing, along with an $800.00 fee to notify Residents. Barb Kriner made a motion to accept the estimate and the fee for notifying residents. April Shuman seconded. All in favor. Action Items: The Danville Area Halloween Parade is Thursday, October 27th. John Domanski gave a recap of the meeting with PennDot on 9/19 regarding signage due to tractor trailer trucks going the wrong way and getting stuck. The Borough would have to hire a consultant to do a study. John Domanski stated they will take another look to see if signs can be eliminated and new ones put up. Beth suggested paint on the roads. John said he will draft a letter requesting paint directions on the roadway. Northumberland County Hazard Mitigation Plan, the Borough will be adopting a resolution for this plan. A letter of resignation was received from SEO, James Sanders, effective October 1, 2022. The Borough will contact individuals for the position. 2023 Budget Committee will be Barb Kriner, Brian Whitenight, Peter Fleming and April Shuman. Beth Rake motioned to accept the Action Items and Brian Whitenight seconded the motion. All in favor. At 8:16pm, Barb motioned to move into the Executive Session. Peter Fleming seconded.
